In order to better understand giftedness and become a part of a process that ultimately will impact your child's education, it is important to become familiar with the federal, state and school definition of giftedness. Furthermore, it is crucial to know the laws associated with the programs.

The Federal Definition of A 'Gifted' Student
"Gifted and talented children are those identified by professionally qualified persons, who by virtue of outstanding abilities are capable of high performance. These are children who require differentiated educational programs and/or services beyond those normally provided by the regular school program in order to realize their contribution to self and society.
"Children capable of high performance include those with demonstrated achievement and/or potential ability in any of the following areas, singly or in combination:

General intellectual ability,

Specific academic aptitude,

Creative or productive thinking,

Leadership ability,
-
Visual and performing arts."

Kentucky Giftedness Definition &
Law
According to ("Kentucky Department of Education : Gifted and Talented," 2016)
The state of Kentucky not only defines, but also supports the Gifted and talented programs by defining, researching, and implementing laws that supports the gifted and talented students.
KRS 157.200(1)(n) includes within the definition of "exceptional children" a category of "exceptional students" who are identified as possessing demonstrated or potential ability to perform at an exceptionally high level in general intellectual aptitude, specific academic aptitude, creative or divergent thinking, psychosocial or leadership skills, or in the visual or performing arts.
KRS 157.224(1) commits the state to a comprehensive educational program for its exceptional school-aged children. KRS 157.230 requires all school districts to operate programs for resident exceptional children, primary - grade twelve (12). This administrative regulation establishes the requirements for programs for gifted and talented students.
In accordance with state regulations, Raceland-Worthington Independent Schools define gifted and talented students as a category of exceptional children. Gifted and talented students in grades K-12 are those identified as possessing demonstrated or potential ability to perform at an exceptionally high level in one or more of the following areas:
• General Intellectual Aptitude
• Specific Academic Aptitude
• Creativity
• Leadership
• Visual and Performing Arts

Independent School definition of giftedness & Law
(District Policy-Curriculum and Instruction 08.132) -All screeners and/or tests are given to every student within the specific grade level. This provides equal access for racial and ethnic minority students, disadvantaged students, and students with disabilities.
